As of January 1, 2002 California Law (California Vehicle Code, Sections 27360-27365)(California Vehicle Code Sections 27360-27365) requires:
- Children to be properly secured in a child seat or booster seat until they are at least 6-years old or weighing at least 60-pounds
- Children under 16-years of age but at least 6-years old or 60-pounds to ride in:
- Child restraint system (car seat, booster, harness, or other product certified to meet Federal Safety Standards), or
- Properly fitted safety belt (lap belt touching the thighs and shoulder belt on child's shoulder, not under their arm or behind their back).
parent, either as a driver or passenger, can be cited for each child under 6 years of age or weighing less than 60 pounds that is not properly retrained in a child safety seat. The California Vehicle Code states that the fine for a child seat violation is $100. However, the violator can pay as much as $270 with penalty assessments, as determined by the courts. In addition, one point is added to the violator's driving record. The fine for a second offense is raised to $250 (violator can pay up to $675 with penalty assessments).
